NOTICE: Recently a class action notice known as Runyan v. Life Investors Insurance Company of America / Transamerica was mailed to all policyholders of Life Investors Insurance Company of America, Transamerica Life Insurance Company, Monumental Life Insurance Company, and Aegon USA, Inc. who possessed a policy during the years 2004 through 2006. Though our firm is not involved in this class action, many of our clients and other Georgia residents may have received notice of the class action and need help in determining their legal rights. As it turns out, it appears that for many class members, the relief is not an adequate remedy. In fact, the Runyan class settlement may be woefully inadequate for policyholders and the agreement appears suspect on its face.

WHAT CAN YOU DO? The answer is “opt out” or “object” to the class action settlement in its entirety.

WHEN DO I NEED TO OPT OUT OR OBJECT? The deadline to exclude yourself (opt out) from this class is June 29, 2009. The deadline to object to the settlement in its entirety is also June 29. 2009. So act now.

HOW DO I KNOW IF THE CLASS ACTION IMPACTS ME? Like many of our clients, you may have received notice of the class action. But sometimes adequate notice is not received. If you have a question in this regard, we urge you to call now for your free consultation. All consumers who purchased cancer insurance policies with Life Investors Insurance Company of America, Transamerica Life Insurance Company, Monumental Life Insurance Company, and Aegon USA, Inc. between 2004-2006 are potentially effected by the class action regardless of whether you received notice or not. However, other companies have similar cancer policies that require review as well.

HOW DO I OPT OUT OR OBJECT? If you or anyone you know are impacted by this class action and want to know more about your legal rights, WE CAN HELP. We are working with a national mass tort law firm to evaluate the class action and individual rights of the impacted policy holders to help determine the best course of action. The consultation is free and the time for taking action is running out. CALL (770) 392-6080 and ask for one of the partners of our firm.

Sending this message does not create an attorney-client relationship, which can be done only after personal consultation and with a written retainer agreement.
