$1,000,000 arbitration award (full policy limits) for the wrongful death of a 52-year-old man who at 3:30 a.m. was sitting up in the right travel lane of I-75 after having struck a deer and knocked off his motorcycle. The Defendant truck driver took no evasive action and struck and killed the motorcyclist. The evidence showed that the Defendant truck driver was fatigued and not keeping a proper lookout due, in part, to his violations of the Federal Motor Carrier hours of service regulations that govern professional truck drivers.
